Notice to Persons Interested in Energy Efficiency Building Codes for Residential, Commercial, and Industrial Construction
Pursuant to 34 TAC §19.52, the State Energy Conservation Office (SECO) is accepting written comments on the energy efficiency chapter of the 2024 International Residential Code, published May 2024, for single-family residential construction. Additionally, SECO is accepting written comments on the 2024 International Energy Conservation Code, published August 14, 2024, for all commercial and industrial construction and in residential construction other than single-family residential construction. Comments must be received no later than 30 days after the publication date of this notice.
To achieve energy conservation in single-family residential construction, Health and Safety Code, §388.003(a), adopted the energy efficiency chapter of the International Residential Code (IRC) as it existed on May 1, 2015, as the energy code for use in this state for all single-family residential construction. Health and Safety Code, §388.003(a), authorizes SECO to amend or adopt and substitute for that energy code the latest published edition of the IRC's energy efficiency chapter, after required analysis and based on written findings on the chapter's stringency from the Energy Systems Laboratory at the Texas A&M Engineering Experiment Station ("Laboratory"). SECO will receive the Laboratory's recommendation on the efficacy of the 2024 IRC's energy efficiency chapter compared to the 2015 IRC's energy efficiency chapter. Health and Safety Code, §388.003(b-3), requires the Laboratory to consider the written comments that SECO receives under this notice.
To achieve energy conservation in all commercial and industrial construction and in residential construction other than single-family residential construction, Health and Safety Code, §388.003(b), adopted the International Energy Conservation Code (IECC) as it existed on May 1, 2001, as the energy code for use in this state for all such construction. Health and Safety Code, §388.003(b), authorizes SECO to amend or adopt and substitute for that energy code the latest published edition of the IECC based on the Laboratory's written findings on the edition's stringency. In 2015, the Laboratory found that the 2015 IECC would result in equivalent or better residential and commercial energy efficiency and air quality than the 2001 IECC. Effective November 1, 2016, SECO adopted the IECC as it existed on May 1, 2015, as the energy code for all commercial and industrial construction and in residential construction other than single-family residential construction. SECO will receive the Laboratory's recommendation on the efficacy of the 2024 IECC compared to the 2015 version of the IECC. Health and Safety Code, §388.003(b-3), requires the Laboratory to consider the written comments that SECO receives under this notice.
SECO encourages comments on the 2024 IECC and the 2024 IRC's energy efficiency chapter from any persons interested in energy efficiency building codes for residential, commercial, and industrial construction, including without limitation: commercial and residential builders; architects and engineers; municipal, county, and other local government authorities; environmental groups; public and private electric, gas, and water utilities; and manufacturers of building materials and products. You can purchase copies of the 2015 IECC and IRC as well as the 2024 IECC and IRC from the International Code Council website at https://shop.iccsafe.org/international-codes/2024-international-energy-conservation-coder.html. The Texas Commission on Environmental Quality (TCEQ, agency, or commission) staff is providing an opportunity for written public comment on the listed Agreed Orders (AOs) in accordance with Texas Water Code (TWC), §7.075. Notice of Completion of Technical Review for Minor Amendment Radioactive Material License Number R04100
APPLICATION. Waste Control Specialists LLC (WCS) has applied to the Texas Commission on Environmental Quality (TCEQ) for a minor amendment to a radioactive material license that authorizes the commercial disposal of Low-Level Radioactive Waste (LLRW) and storage and processing of radioactive substances. The facility is located at 9998 State Highway 176 West, one mile north of State Highway 176 and 250 feet east of the Texas and New Mexico State Line (30 miles west of Andrews, Texas) in Andrews County, Texas. The application for a minor amendment was received on July 19, 2024 with modifications to the amendment application received January 14, 2025, April 4, 2025, and July 15, 2025.
The facility is located at 9998 State Highway 176 West in Andrews County, Texas. PRELIMINARY DECISION. The TCEQ Executive Director has completed the technical review of the amendment application and prepared a draft license. The draft license, if approved, would establish the conditions under which the facility must operate. The Executive Director has made a preliminary decision that this license, if issued, meets all statutory and regulatory requirements.
The TCEQ Executive Director has determined that a minor amendment to the license is appropriate because it does not pose a detrimental impact and is in consideration of maintaining public health and safety, worker safety, and environmental health. The license will be amended to authorize the reduction of the concrete strength requirement for the Modular Concrete Canisters (MCCs) from 5,000 psi to 4,000 psi and the 2,000 psi grout void-fill material requirement with 200 psi controlled low-strength material (CLSM); the modification of the requirement that 2,000 psi concrete be used for backfill of rubble and debris bulk waste to allow the use of 200 psi CLSM; the construction of a new cask off-load facility; that in-situ red bed clay is a material "technologically equivalent or superior" to the material applied to the disposal facility liner for temporarily sealing the catch basins; that catch basins and ledge ditches with an unlined gravel subsurface drain and sump do not need to have an automatic pumping system or an extra foot of freeboard if it is designed for the 100-year, 24-hour storm event; the revision of procedure EV-1.0.0, Consolidated Radiological Environmental Monitoring Program (REMP), to update the list of monitoring wells, remove C-14, I-129, and Kr-85 as key radionuclides monitored for several media, and remove the use of cartridges for low volume air sampling; the consolidation of two license conditions into one license condition with no modification to requirements; the removal of the requirement for an investigation on whether the Ranch House Draw is integrated with the Monument Draw since this was fulfilled in 2011; the removal of the requirement regarding a small playa located on the eastern edge of the Compact Waste Disposal Facility (CWF) since this playa was removed during construction of the Phase 2a expansion of the CWF; the removal of the requirement to install two wells for the 225 foot layer if the thickness of the 225 foot layer at that location is less than 15 feet or is absent; the removal of the requirement to install a 180 foot well if the 125 foot well becomes saturated; that the requirement for the annual and for-cause internal contamination surveys to be whole body counts be changed to bioassay; the change of the due date for the annual dose report from March 31 to April 10; that the requirement that the laboratory conducting the bioassay submit their Quality Assurance (QA) program to the executive director be changed to a requirement that they submit it upon request of the executive director; the removal of the requirement that step-off pads be located outside posted contamination areas and/or high contamination areas if these areas are located outdoors; the modification of "area" to "restricted area" for the requirement that workers be surveyed when exiting an "area" where contact with radioactive material is possible; the change of the due date for the annual REMP report from May 31 to June 30; the use of native red bed clays to replace the concrete layer in the cover and caliche gravel to replace the concrete layer in the floors and sidewalls of the CWF and the Federal Waste Facility (FWF) as materials that are "technologically equivalent or superior" to concrete; the replacement of the prentice arm with a mobile excavator for waste processing; the removal of the requirement that tier 1 and 2 waste containing depleted uranium received under license condition 192 be classified as Tier 3 regardless of the sum of fractions or concentration value; decrease the sampling frequency of 225-foot zone groundwater wells; and by initiative of the Executive Director to update the contact information.

Notice of Public Hearing on Proposed Revisions to 30 TAC Chapter 116 and to the State Implementation Plan
The Texas Commission on Environmental Quality (commission) will conduct a public hearing to receive testimony regarding proposed revisions to 30 Texas Administrative Code (TAC) Chapter 116, Control of Air Pollution by Permits for New Construction or Modification, §116.605, and corresponding revisions to the state implementation plan (SIP) under the requirements of Texas Health and Safety Code, §382.017; Texas Government Code, Chapter 2001, Subchapter B; and 40 Code of Federal Regulations §51.102 of the United States Environmental Protection Agency (EPA) concerning SIPs.
To implement the requirements of SB 763 and SB 2351, 89th Regular Texas Legislature, 2025, the commission proposes to amend 30 TAC Chapter 116, Subchapter F (Standard Permits). The proposed rulemaking would add §116.605(d)(4) requiring a protectiveness review to be conducted for the Air Quality Standard Permit for Concrete Batch Plants (CBP SP) at least once every eight years. The proposed rulemaking would also add §116.605(f)(1) and (2) that would be applicable only when an amendment to CBP SP or the Air Quality Standard Permit for Concrete Batch Plants with Enhanced Controls is issued by the commission. New §116.605(f)(1) and (2) would outline criteria of how the commission may require an operator of a permanent facility that is authorized to begin new construction under the former standard permit to update the permanent facility's plans for the new construction to comply with the amended standard permit if the facility operator did not begin the construction before the adoption of the amended standard permit and the operator filed a request for an extension to begin construction.
The commission will hold a hybrid in-person and virtual public hearing on this proposal in Austin on Thursday, November 20, 2025, at 2:00 p.m. in Building E, Room 201S, at the commission's central office located at 12100 Park 35 Circle. The hearing is structured for the receipt of oral or written comments by interested persons. Individuals may present oral statements when called upon in order of registration. Open discussion will not be permitted during the hearing; however, commission staff members will be available to discuss the proposal 30 minutes prior to the hearing at 1:30 p.m.

On January 10, 1997, the State of Texas received federal approval of the Coastal Management Program (CMP) (62 Federal Register pp. 1439 - 1440). Project Description: FM 522 bridge replacement. The proposed project would extend for a total of 0.355 miles along FM 522 at the San Bernard River. Roadway improvements would take place within the existing right of way. The proposed facility would remove and replace the bridge to existing conditions with a new shifted centerline 0 to 18 feet west of its current location. After this shift, the remaining right of way would measure approximately 16.19 feet on the left side and 43.13 feet on the right. The proposed facility would be 50.58 feet wide and span a total length of 631.65 feet.

Location: The project would affect waters of the United States associated with estuarine marine wetlands adjacent to Swan Lake at 212 Beachcomber Avenue, Surfside, Brazoria County, Texas.

Project Description: To provide a single-family residence on privately owned property in the community of Surfside, Texas. The applicant proposes to discharge 110 cubic yards of fill material into a 5,330-square-foot area (0.12-acre) of estuarine marine wetlands (E2EM) wetlands for the construction of a single-family home. The home components include a 1,200-square-foot home and 360-square-foot deck, supported by timber pilings. Additional components include a 2,080-square-foot driveway and 900-square-foot septic system. For construction, the soil fill will be placed in the 2,080-square-foot driveway beneath the 1,200-square-foot home and in the 900-square-foot septic system footprint. The driveway will be topped with six inches of crushed concrete. During the piling installation, temporary impacts will occur within the same footprint as the permanent impact area. The pilings that are placed behind the home and deck will be installed using a mechanical pile driving hammer. The fill material will be placed and the septic system installed with a backhoe, or skid steer.
The applicant has provided the following explanation why compensatory mitigation should not be required: The initially desired project would have had an impact of 0.13 acre of impacts to tidal wetlands, but the applicant reduced the square footage of the home such that impacts are near threshold for the Nationwide Permit program, with only 0.12 acre of impacts. Due to the minimized footprint, no compensatory mitigation is proposed.
Type of Application: U.S. Army Corps of Engineers permit application # SWG-2025-00289. This application will be reviewed pursuant Section 404 of the Clean Water Act. Note: The consistency review for this project may be conducted by Texas Commission on Environmental Quality as part of its certification under §401 of the Clean Water Act.

Auctioneers Penalties and Sanctions
The Texas Commission of Licensing and Regulation (Commission) provides this public notice that, at their regularly scheduled meeting held on August 21, 2025, the Commission adopted the Texas Department of Licensing and Regulation's (Department) revised enforcement plan, which was established in compliance with Texas Occupations Code § 51.302(c).
The enforcement plan gives all license holders notice of the specific ranges of penalties and license sanctions that apply to specific alleged violations of the statutes and rules enforced by the Department. The enforcement plan also presents the criteria that are considered by the Department's Enforcement staff in determining the amount of a proposed administrative penalty or the magnitude of a proposed sanction. The enforcement plan is revised to include the penalty matrix for the Auctioneer program.
The penalty matrix for the Auctioneer program was last updated on March 28, 2007. Revisions to the matrix include: (1) incorporating new statutory requirements violations, (2) consolidating violations into four classes, and (3) other cleanup to ensure correct rule and law citations and plain language.
The Auctioneer Board recommended approval of the penalty matrix at their meeting held on June 26, 2025. The penalty matrix was presented to the Commission on August 21, 2025, and was adopted as recommended.

Electric Vehicle Charging Stations Penalties and Sanctions
The Texas Commission of Licensing and Regulation (Commission) provides this public notice that, at their regularly scheduled meeting held on August 21, 2025, the Commission adopted the Texas Department of Licensing and Regulation's (Department) revised enforcement plan, which was established in compliance with Texas Occupations Code § 51.302(c).
The enforcement plan gives all license holders notice of the specific ranges of penalties and license sanctions that apply to specific alleged violations of the statutes and rules enforced by the Department. The enforcement plan also presents the criteria that are considered by the Department's Enforcement staff in determining the amount of a proposed administrative penalty or the magnitude of a proposed sanction. The enforcement plan is revised to include the penalty matrix for the Electric Vehicle Charging Stations program.
The Texas Legislature enacted Senate Bill 1001 and 1002, 88th Legislature, Regular Session (2023), which gave regulatory authority of Electric Vehicle Charging Stations to the Commission and Department.
The Electric Vehicle Charging Stations Workgroup assisted in the creation of the penalty matrix on April 2, 2025. The penalty matrix was presented to the Commission on August 21, 2025, and was adopted as recommended.

1.1 Price of Scratch Ticket Game.
A. The price for Scratch Ticket Game No. 2704 shall be $5.00 per Scratch Ticket.
1.2 Definitions in Scratch Ticket Game No. 2704.
A. Display Printing - That area of the Scratch Ticket outside of the area where the overprint and Play Symbols appear.
B. Latex Overprint - The removable scratch-off covering over the Play Symbols on the front of the Scratch Ticket.
C. Play Symbol - The printed data under the latex on the front of the Scratch Ticket that is used to determine eligibility for a prize. Each Play Symbol is printed in Symbol font in black ink in positive except for dual-image games. E. Serial Number - A unique thirteen (13) digit number appearing under the latex scratch-off covering on the front of the Scratch Ticket. The Serial Number is for validation purposes and cannot be used to play the game. The format will be: 0000000000000.
F. Bar Code - A twenty-four (24) character interleaved two (2) of five (5) Bar Code which will include a four (4) digit game ID, the seven (7) digit Pack number, the three (3) digit Ticket number and the ten (10) digit Validation Number. The Bar Code appears on the back of the Scratch Ticket.
G. Game-Pack-Ticket Number - A fourteen (14) digit number consisting of the four (4) digit game number (2704), a seven (7) digit Pack number, and a three (3) digit Ticket number. Ticket numbers start with 001 and end with 075 within each Pack. The format will be: 2704-0000001-001.
H. Pack - A Pack of the "BIG CA$H" Scratch Ticket Game contains 075 Tickets, packed in plastic shrink-wrapping and fanfolded in pages of one (1). The Packs will alternate. One will show the front of Ticket 001 and back of 075 while the other fold will show the back of Ticket 001 and front of 075.
I. Non-Winning Scratch Ticket - A Scratch Ticket which is not programmed to be a winning Scratch Ticket or a Scratch Ticket that does not meet all of the requirements of these Game Procedures, the State Lottery Act (Texas Government Code, Chapter 466), and applicable rules adopted by the Texas Lottery and Charitable Bingo Division of the Texas Department of Licensing and Regulation (Texas Lottery) pursuant to the State Lottery Act and referenced in 16 TAC, Chapter 140.
J. Scratch Ticket Game, Scratch Ticket or Ticket - Texas Lottery "BIG CA$H" Scratch Ticket Game No. 2704.
2.0 Determination of Prize Winners. The determination of prize winners is subject to the general Scratch Ticket validation requirements set forth in Texas Lottery Rule 140.302, Scratch Ticket Game Rules, these Game Procedures, and the requirements set out on the back of each Scratch Ticket. A prize winner in the "BIG CA$H" Scratch Ticket Game is determined once the latex on the Scratch Ticket is scratched off to expose forty-five (45) Play Symbols. If a player matches any of the YOUR NUMBERS Play Symbols to any of the WINNING NUMBERS Play Symbols, the player wins the PRIZE for that number. If the player reveals a "STACK OF CASH" Play Symbol, the player wins TRIPLE the PRIZE for that symbol. No portion of the Display Printing nor any extraneous matter whatsoever shall be usable or playable as a part of the Scratch Ticket.
2.1 Scratch Ticket Validation Requirements.
A. To be a valid Scratch Ticket, all of the following requirements must be met:
1. Exactly forty-five (45) Play Symbols must appear under the Latex Overprint on the front portion of the Scratch Ticket;
2. Each of the Play Symbols must have a Play Symbol Caption underneath, unless specified, and each Play Symbol must agree with its Play Symbol Caption;
3. Each of the Play Symbols must be present in its entirety and be fully legible;
4. Each of the Play Symbols must be printed in black ink except for dual image games;
5. The Scratch Ticket shall be intact;
6. The Serial Number and Game-Pack-Ticket Number must be present in their entirety and be fully legible;
7. The Serial Number must correspond, using the Texas Lottery's codes, to the Play Symbols on the Scratch Ticket;
8. The Scratch Ticket must not have a hole punched through it, be mutilated, altered, unreadable, reconstituted or tampered with in any manner;
9. The Scratch Ticket must not be counterfeit in whole or in part;
10. The Scratch Ticket must have been issued by the Texas Lottery in an authorized manner;
11. The Scratch Ticket must not have been stolen, nor appear on any list of omitted Scratch Tickets or non-activated Scratch Tickets on file at the Texas Lottery;
12. The Play Symbols, Serial Number and Game-Pack-Ticket Number must be right side up and not reversed in any manner;
13. The Scratch Ticket must be complete and not miscut, and have exactly forty-five (45) Play Symbols under the Latex Overprint on the front portion of the Scratch Ticket, exactly one Serial Number and exactly one Game-Pack-Ticket Number on the Scratch Ticket;
14. The Serial Number of an apparent winning Scratch Ticket shall correspond with the Texas Lottery's Serial Numbers for winning Scratch Tickets, and a Scratch Ticket with that Serial Number shall not have been paid previously;
15. The Scratch Ticket must not be blank or partially blank, misregistered, defective or printed or produced in error;
16. Each of the forty-five (45) Play Symbols must be exactly one of those described in Section 1.2.C of these Game Procedures;
17. Each of the forty-five (45) Play Symbols on the Scratch Ticket must be printed in the Symbol font and must correspond precisely to the artwork on file at the Texas Lottery; the Scratch Ticket Serial Numbers must be printed in the Serial font and must correspond precisely to the artwork on file at the Texas Lottery; and the Game-Pack-Ticket Number must be printed in the Game-Pack-Ticket Number font and must correspond precisely to the artwork on file at the Texas Lottery;
18. The Display Printing on the Scratch Ticket must be regular in every respect and correspond precisely to the artwork on file at the Texas Lottery; and
19. The Scratch Ticket must have been received by the Texas Lottery by applicable deadlines.
B. The Scratch Ticket must pass all additional validation tests provided for in these Game Procedures, the Texas Lottery's Rules governing the award of prizes of the amount to be validated, and any confidential validation and security tests of the Texas Lottery.
C. Any Scratch Ticket not passing all of the validation requirements is void and ineligible for any prize and shall not be paid. However, the Executive Director of the Texas Lottery (Executive Director) may, solely at the Executive Director's discretion, refund the retail sales price of the Scratch Ticket. In the event a defective Scratch Ticket is purchased, the only responsibility or liability of the Texas Lottery shall be to replace the defective Scratch Ticket with another unplayed Scratch Ticket in that Scratch Ticket Game (or a Scratch Ticket of equivalent sales price from any other current Texas Lottery Scratch Ticket Game) or refund the retail sales price of the Scratch Ticket, solely at the Executive Director's discretion.
2.2 Programmed Game Parameters.
A. A Ticket can win up to twenty (20) times in accordance with the prize structure.
B. Consecutive Non-Winning Tickets within a Pack will not have matching patterns, in the same order, of either Play Symbols or Prize Symbols.
C. Each Ticket will have five (5) different WINNING NUMBERS Play Symbols.
D. Non-winning YOUR NUMBERS Play Symbols will all be different.
E. Non-winning Prize Symbols will never appear more than three (3) times.
F. The top Prize Symbol will appear on every Ticket, unless restricted by other parameters, play action or prize structure.
G. The "STACK OF CASH" (TRP) Play Symbol will never appear in the WINNING NUMBERS Play Symbol spots.
H. The "STACK OF CASH" (TRP) Play Symbol will only appear on winning Tickets as dictated by the prize structure.
I. Non-winning Prize Symbol(s) will never be the same as the winning Prize Symbol(s).
J. No prize amount in a non-winning spot will correspond with the YOUR NUMBERS Play Symbol (i.e., 20 and $20).
2.3 Procedure for Claiming Prizes.
A. To claim a "BIG CA$H" Scratch Ticket Game prize of $5.00, $10.00, $15.00, $20.00, $50.00, $100 or $500, a claimant shall sign the back of the Scratch Ticket in the space designated on the Scratch Ticket and may present the winning Scratch Ticket to any Texas Lottery Retailer. The Texas Lottery Retailer shall verify the claim and, if valid, and upon presentation of proper identification, if appropriate, make payment of the amount due the claimant and physically void the Scratch Ticket; provided that the Texas Lottery Retailer may, but is not required, to pay a $50.00, $100 or $500 Scratch Ticket Game. In the event the Texas Lottery Retailer cannot verify the claim, the Texas Lottery Retailer shall provide the claimant with a claim form and instruct the claimant on how to file a claim with the Texas Lottery. If the claim is validated by the Texas Lottery, a check shall be forwarded to the claimant in the amount due. In the event the claim is not validated, the claim shall be denied and the claimant shall be notified promptly. A claimant may also claim any of the above prizes under the procedure described in Section 2.3.B and Section 2.3.C of these Game Procedures.
B. To claim a "BIG CA$H" Scratch Ticket Game prize of $1,000 or $100,000, the claimant must sign the winning Scratch Ticket and may present it at one of the Texas Lottery's Claim Centers. If the claim is validated by the Texas Lottery, payment will be made to the bearer of the validated winning Scratch Ticket for that prize upon presentation of proper identification. When paying a prize of $600 or more, the Texas Lottery shall file the appropriate income reporting form with the Internal Revenue Service (IRS) and shall withhold federal income tax at a rate set by the IRS if required. In the event that the claim is not validated by the Texas Lottery, the claim shall be denied and the claimant shall be notified promptly.
C. As an alternative method of claiming a "BIG CA$H" Scratch Ticket Game prize, the claimant may submit the signed winning Scratch Ticket and a thoroughly completed claim form via mail. If a prize value is $1,000,000 or more, the claimant must also provide proof of Social Security number or Tax Payer Identification (for U.S. Citizens or Resident Aliens). Mail all to: Texas Lottery, P.O. Box 16600, Austin, Texas 78761-6600. The Texas Lottery is not responsible for Scratch Tickets lost in the mail. In the event that the claim is not validated by the Texas Lottery, the claim shall be denied and the claimant shall be notified promptly.
D. Prior to payment by the Texas Lottery of any prize, the Texas Lottery shall deduct the amount of a delinquent tax or other money from the winnings of a prize winner who has been finally determined to be:
1. delinquent in the payment of a tax or other money to a state agency and that delinquency is reported to the Comptroller under Government Code §403.055;
2. in default on a loan made under Chapter 52, Education Code;
3. in default on a loan guaranteed under Chapter 57, Education Code; or
4. delinquent in child support payments in the amount determined by a court or a Title IV-D agency under Chapter 231, Family Code.
E. If a person is indebted or owes delinquent taxes to the State, other than those specified in the preceding paragraph, the winnings of a person shall be withheld until the debt or taxes are paid.
2.4 Allowance for Delay of Payment. The Texas Lottery may delay payment of the prize pending a final determination by the Executive Director, under any of the following circumstances:
A. if a dispute occurs, or it appears likely that a dispute may occur, regarding the prize;
B. if there is any question regarding the identity of the claimant;
C. if there is any question regarding the validity of the Scratch Ticket presented for payment; or
D. if the claim is subject to any deduction from the payment otherwise due, as described in Section 2.3.D of these Game Procedures. No liability for interest for any delay shall accrue to the benefit of the claimant pending payment of the claim.
2.5 Payment of Prizes to Persons Under 18. If a person under the age of 18 years is entitled to a cash prize under $600 from the "BIG CA$H" Scratch Ticket Game, the Texas Lottery shall deliver to an adult member of the minor's family or the minor's guardian a check or warrant in the amount of the prize payable to the order of the minor.
2.6 If a person under the age of 18 years is entitled to a cash prize of $600 or more from the "BIG CA$H" Scratch Ticket Game, the Texas Lottery shall deposit the amount of the prize in a custodial bank account, with an adult member of the minor's family or the minor's guardian serving as custodian for the minor.
2.7 Scratch Ticket Claim Period. All Scratch Ticket prizes must be claimed within 180 days following the end of the Scratch Ticket Game or within the applicable time period for certain eligible military personnel as set forth in Texas Government Code §466.408. Any rights to a prize that is not claimed within that period, and in the manner specified in these Game Procedures and on the back of each Scratch Ticket, shall be forfeited.
2.8 Disclaimer. The number of prizes in a game is approximate based on the number of Scratch Tickets ordered. The number of actual prizes available in a game may vary based on number of Scratch Tickets manufactured, testing, distribution, sales and number of prizes claimed. A Scratch Ticket Game may continue to be sold even when all the top prizes have been claimed.
3.0 Scratch Ticket Ownership.
A. Until such time as a signature is placed upon the back portion of a Scratch Ticket in the space designated, a Scratch Ticket shall be owned by the physical possessor of said Scratch Ticket. When a signature is placed on the back of the Scratch Ticket in the space designated, the player whose signature appears in that area shall be the owner of the Scratch Ticket and shall be entitled to any prize attributable thereto. Notwithstanding any name or names submitted on a claim form, the Executive Director shall make payment to the player whose signature appears on the back of the Scratch Ticket in the space designated. If more than one name appears on the back of the Scratch Ticket, the Executive Director will require that one of those players whose name appears thereon be designated by such players to receive payment.
B. The Texas Lottery shall not be responsible for lost or stolen Scratch Tickets and shall not be required to pay on a lost or stolen Scratch Ticket.
4.0 Number and Value of Scratch Prizes. There will be approximately 5,040,000 Scratch Tickets in Scratch Ticket Game No. 2704. The approximate number and value of prizes in the game are as follows:

A. The actual number of Scratch Tickets in the game may be increased or decreased at the sole discretion of the Texas Lottery.
5.0 End of the Scratch Ticket Game. The Executive Director may, at any time, announce a closing date (end date) for the Scratch Ticket Game No. 2704 without advance notice, at which point no further Scratch Tickets in that game may be sold. The determination of the closing date and reasons for closing will be made in accordance with the Scratch Ticket closing procedures and the Scratch Ticket Game Rules. See 16 TAC §140.302(j).
6.0 Governing Law. In purchasing a Scratch Ticket, the player agrees to comply with, and abide by, these Game Procedures for Scratch Ticket Game No. 2704, the State Lottery Act (Texas Government Code, Chapter 466), applicable rules adopted by the Texas Lottery pursuant to the State Lottery Act and referenced in 16 TAC, Chapter 140, and all final decisions of the Executive Director.

In the event a defective Scratch Ticket is purchased, the only responsibility or liability of the Texas Lottery shall be to replace the defective Scratch Ticket with another unplayed Scratch Ticket in that Scratch Ticket Game (or a Scratch Ticket of equivalent sales price from any other current Texas Lottery Scratch Ticket Game) or refund the retail sales price of the Scratch Ticket, solely at the Executive Director's discretion.
2.2 Programmed Game Parameters.
A. GENERAL: A Ticket can win up to twenty-eight (28) times in accordance with the prize structure.
B. GENERAL: Consecutive Non-Winning Tickets within a Pack will not have matching patterns, in the same order, of either Play Symbols or Prize Symbols.
C. KEY NUMBER MATCH: The top Prize Symbol will appear on every Ticket, unless restricted by other parameters, play action or prize structure.
D. KEY NUMBER MATCH: Each Ticket will have five (5) different LUCKY NUMBERS Play Symbols.
E. KEY NUMBER MATCH: Non-winning YOUR NUMBERS Play Symbols will all be different.
F. KEY NUMBER MATCH: Non-winning Prize Symbols will never appear more than three (3) times.
G. KEY NUMBER MATCH: The "5X" (WINX5) and "HORSESHOE" (WINALL) Play Symbols will never appear in the LUCKY NUMBERS or BONUS Play Symbol spots.
H. KEY NUMBER MATCH: The "5X" (WINX5) Play Symbol will only appear on winning Tickets as dictated by the prize structure.
I. KEY NUMBER MATCH: The "HORSESHOE" (WINALL) Play Symbol will only appear on winning Tickets as dictated by the prize structure.
J. KEY NUMBER MATCH: On Tickets that contain the "HORSESHOE" (WINALL) Play Symbol, the BONUS play areas will be non-winning.
K. KEY NUMBER MATCH: On Tickets that contain the "HORSESHOE" (WINALL) Play Symbol, none of the YOUR NUMBERS Play Symbols will match any of the LUCKY NUMBERS Play Symbols, and the "5X" (WINX5) Play Symbol will not appear.
L. KEY NUMBER MATCH: Non-winning Prize Symbols will never be the same as the winning Prize Symbol(s).
M. KEY NUMBER MATCH: No prize amount in a non-winning spot will correspond with the YOUR NUMBERS Play Symbol (i.e., 10 and $10).
N. BONUS: Matching BONUS Play Symbols will only appear in a winning BONUS play area as dictated by the prize structure.
O. BONUS: A BONUS Play Symbol will not be used more than one (1) time per Ticket across the BONUS play areas, unless used in a winning combination.
P. BONUS: The BONUS Play Symbols will never appear in the LUCKY NUMBERS or YOUR NUMBERS Play Symbol spots.
Q. BONUS: In the BONUS play areas, non-winning Play Symbols will not be the same as winning Play Symbols.
R. BONUS: Non-winning BONUS Prize Symbols will never appear more than one (1) time across the BONUS play areas.
S. BONUS: Non-winning BONUS Prize Symbols will never be the same as the winning BONUS Prize Symbol(s).
2.3 Procedure for Claiming Prizes.
A. To claim a "LUCKY MATCH" Scratch Ticket Game prize of $10.00, $15.00, $20.00, $25.00, $30.00, $50.00, $75.00, $100, $250 or $500, a claimant shall sign the back of the Scratch Ticket in the space designated on the Scratch Ticket and may present the winning Scratch Ticket to any Texas Lottery Retailer. The Texas Lottery Retailer shall verify the claim and, if valid, and upon presentation of proper identification, if appropriate, make payment of the amount due the claimant and physically void the Scratch Ticket; provided that the Texas Lottery Retailer may, but is not required, to pay a $25.00, $30.00, $50.00, $75.00, $100, $250 or $500 Scratch Ticket Game. In the event the Texas Lottery Retailer cannot verify the claim, the Texas Lottery Retailer shall provide the claimant with a claim form and instruct the claimant on how to file a claim with the Texas Lottery. If the claim is validated by the Texas Lottery, a check shall be forwarded to the claimant in the amount due. In the event the claim is not validated, the claim shall be denied and the claimant shall be notified promptly. A claimant may also claim any of the above prizes under the procedure described in Section 2.3.B and Section 2.3.C of these Game Procedures.
B. To claim a "LUCKY MATCH" Scratch Ticket Game prize of $1,000, $10,000, $50,000 or $250,000, the claimant must sign the winning Scratch Ticket and may present it at one of the Texas Lottery's Claim Centers. If the claim is validated by the Texas Lottery, payment will be made to the bearer of the validated winning Scratch Ticket for that prize upon presentation of proper identification. When paying a prize of $600 or more, the Texas Lottery shall file the appropriate income reporting form with the Internal Revenue Service (IRS) and shall withhold federal income tax at a rate set by the IRS if required. In the event that the claim is not validated by the Texas Lottery, the claim shall be denied and the claimant shall be notified promptly.
C. As an alternative method of claiming a "LUCKY MATCH" Scratch Ticket Game prize, the claimant may submit the signed winning Scratch Ticket and a thoroughly completed claim form via mail. If a prize value is $1,000,000 or more, the claimant must also provide proof of Social Security number or Tax Payer Identification (for U.S. Citizens or Resident Aliens). Mail all to: Texas Lottery, P.O. Box 16600, Austin, Texas 78761-6600. The Texas Lottery is not responsible for Scratch Tickets lost in the mail. In the event that the claim is not validated by the Texas Lottery, the claim shall be denied and the claimant shall be notified promptly.
D. Prior to payment by the Texas Lottery of any prize, the Texas Lottery shall deduct the amount of a delinquent tax or other money from the winnings of a prize winner who has been finally determined to be:
1. delinquent in the payment of a tax or other money to a state agency and that delinquency is reported to the Comptroller under Government Code §403.055;
2. in default on a loan made under Chapter 52, Education Code;
3. in default on a loan guaranteed under Chapter 57, Education Code; or
4. delinquent in child support payments in the amount determined by a court or a Title IV-D agency under Chapter 231, Family Code.
E. If a person is indebted or owes delinquent taxes to the State, other than those specified in the preceding paragraph, the winnings of a person shall be withheld until the debt or taxes are paid.
2.4 Allowance for Delay of Payment. The Texas Lottery may delay payment of the prize pending a final determination by the Executive Director, under any of the following circumstances:
A. if a dispute occurs, or it appears likely that a dispute may occur, regarding the prize;
B. if there is any question regarding the identity of the claimant;
C. if there is any question regarding the validity of the Scratch Ticket presented for payment; or
D. if the claim is subject to any deduction from the payment otherwise due, as described in Section 2.3.D of these Game Procedures. No liability for interest for any delay shall accrue to the benefit of the claimant pending payment of the claim.
2.5 Payment of Prizes to Persons Under 18. If a person under the age of 18 years is entitled to a cash prize under $600 from the "LUCKY MATCH" Scratch Ticket Game, the Texas Lottery shall deliver to an adult member of the minor's family or the minor's guardian a check or warrant in the amount of the prize payable to the order of the minor.
2.6 If a person under the age of 18 years is entitled to a cash prize of $600 or more from the "LUCKY MATCH" Scratch Ticket Game, the Texas Lottery shall deposit the amount of the prize in a custodial bank account, with an adult member of the minor's family or the minor's guardian serving as custodian for the minor.
2.7 Scratch Ticket Claim Period. All Scratch Ticket prizes must be claimed within 180 days following the end of the Scratch Ticket Game or within the applicable time period for certain eligible military personnel as set forth in Texas Government Code §466.408. Any rights to a prize that is not claimed within that period, and in the manner specified in these Game Procedures and on the back of each Scratch Ticket, shall be forfeited.
2.8 Disclaimer. The number of prizes in a game is approximate based on the number of Scratch Tickets ordered. The number of actual prizes available in a game may vary based on number of Scratch Tickets manufactured, testing, distribution, sales and number of prizes claimed. A Scratch Ticket Game may continue to be sold even when all the top prizes have been claimed.
3.0 Scratch Ticket Ownership.
A. Until such time as a signature is placed upon the back portion of a Scratch Ticket in the space designated, a Scratch Ticket shall be owned by the physical possessor of said Scratch Ticket. When a signature is placed on the back of the Scratch Ticket in the space designated, the player whose signature appears in that area shall be the owner of the Scratch Ticket and shall be entitled to any prize attributable thereto. Notwithstanding any name or names submitted on a claim form, the Executive Director shall make payment to the player whose signature appears on the back of the Scratch Ticket in the space designated. If more than one name appears on the back of the Scratch Ticket, the Executive Director will require that one of those players whose name appears thereon be designated by such players to receive payment.
B. The Texas Lottery shall not be responsible for lost or stolen Scratch Tickets and shall not be required to pay on a lost or stolen Scratch Ticket.
4.0 Number and Value of Scratch Prizes. There will be approximately 8,040,000 Scratch Tickets in Scratch Ticket Game No. 2705. The approximate number and value of prizes in the game are as follows:

A. The actual number of Scratch Tickets in the game may be increased or decreased at the sole discretion of the Texas Lottery.
5.0 End of the Scratch Ticket Game. The Executive Director may, at any time, announce a closing date (end date) for the Scratch Ticket Game No. 2705 without advance notice, at which point no further Scratch Tickets in that game may be sold. The determination of the closing date and reasons for closing will be made in accordance with the Scratch Ticket closing procedures and the Scratch Ticket Game Rules. See 16 TAC §140.302(j).
6.0 Governing Law. In purchasing a Scratch Ticket, the player agrees to comply with, and abide by, these Game Procedures for Scratch Ticket Game No. 2705, the State Lottery Act (Texas Government Code, Chapter 466), applicable rules adopted by the Texas Lottery pursuant to the State Lottery Act and referenced in 16 TAC, Chapter 140, and all final decisions of the Executive Director.

1.0 Name and Style of Scratch Ticket Game.
A. The name of Scratch Ticket Game No. 2709 is "PLATINUM MILLIONS". The play style is "key number match".
1.1 Price of Scratch Ticket Game.
A. The price for Scratch Ticket Game No. 2709 shall be $30.00 per Scratch Ticket.
1.2 Definitions in Scratch Ticket Game No. 2709.
A. Display Printing - That area of the Scratch Ticket outside of the area where the overprint and Play Symbols appear.
B. Latex Overprint - The removable scratch-off covering over the Play Symbols on the front of the Scratch Ticket.
C. Play Symbol - The printed data under the latex on the front of the Scratch Ticket that is used to determine eligibility for a prize. Each Play Symbol is printed in Symbol font in black ink in positive except for dual-image games. The possible black Play Symbols are: 01, 03, 04, 06, 07, 08, 09, 11, 12, 13, 14, 15, 16, 17, 18, 19, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 49, 50, 2X SYMBOL, 5X SYMBOL, 10X SYMBOL, 20X SYMBOL, $50.00, $100, $150, $200, $500, $3,000, $30,000 and $1,000,000.
D. Play Symbol Caption - The printed material appearing below each Play Symbol which explains the Play Symbol. One caption appears under each Play Symbol and is printed in caption font in black ink in positive. The Play Symbol Caption which corresponds with and verifies each Play Symbol is as follows:

E. Serial Number - A unique thirteen (13) digit number appearing under the latex scratch-off covering on the front of the Scratch Ticket. The Serial Number is for validation purposes and cannot be used to play the game. The format will be: 0000000000000.
F. Bar Code - A twenty-four (24) character interleaved two (2) of five (5) Bar Code which will include a four (4) digit game ID, the seven (7) digit Pack number, the three (3) digit Ticket number and the ten (10) digit Validation Number. The Bar Code appears on the back of the Scratch Ticket.
G. Game-Pack-Ticket Number - A fourteen (14) digit number consisting of the four (4) digit game number (2709), a seven (7) digit Pack number, and a three (3) digit Ticket number. Ticket numbers start with 001 and end with 025 within each Pack. The format will be: 2709-0000001-001.
H. Pack - A Pack of the "PLATINUM MILLIONS" Scratch Ticket Game contains 025 Tickets, packed in plastic shrink-wrapping and fanfolded in pages of one (1). The Packs will alternate. One will show the front of Ticket 001 and back of 025 while the other fold will show the back of Ticket 001 and front of 025.
I. Non-Winning Scratch Ticket - A Scratch Ticket which is not programmed to be a winning Scratch Ticket or a Scratch Ticket that does not meet all of the requirements of these Game Procedures, the State Lottery Act (Texas Government Code, Chapter 466), and applicable rules adopted by the Texas Lottery and Charitable Bingo Division of the Texas Department of Licensing and Regulation (Texas Lottery) pursuant to the State Lottery Act and referenced in 16 TAC, Chapter 140.
J. Scratch Ticket Game, Scratch Ticket or Ticket - Texas Lottery "PLATINUM MILLIONS" Scratch Ticket Game No. 2709.
2.0 Determination of Prize Winners. The determination of prize winners is subject to the general Scratch Ticket validation requirements set forth in Texas Lottery Rule 140.302, Scratch Ticket Game Rules, these Game Procedures, and the requirements set out on the back of each Scratch Ticket. A prize winner in the "PLATINUM MILLIONS" Scratch Ticket Game is determined once the latex on the Scratch Ticket is scratched off to expose seventy-four (74) Play Symbols. BONUS PLAY INSTRUCTIONS: If the player reveals 2 matching prize amounts in the same BONUS, the player wins that amount. PLATINUM MILLIONS PLAY INSTRUCTIONS: If the player matches any of the YOUR NUMBERS Play Symbols to any of the WINNING NUMBERS Play Symbols, the player wins the PRIZE for that number. If the player reveals a "2X" Play Symbol, the player wins DOUBLE the PRIZE for that symbol. If the player reveals a "5X" Play Symbol, the player wins 5 TIMES the PRIZE for that symbol. If the player reveals a "10X" Play Symbol, the player wins 10 TIMES the PRIZE for that symbol. If the player reveals a "20X" Play Symbol, the player wins 20 TIMES the PRIZE for that symbol. No portion of the Display Printing nor any extraneous matter whatsoever shall be usable or playable as a part of the Scratch Ticket.
2.1 Scratch Ticket Validation Requirements.
A. To be a valid Scratch Ticket, all of the following requirements must be met:
1. Exactly seventy-four (74) Play Symbols must appear under the Latex Overprint on the front portion of the Scratch Ticket;
2. Each of the Play Symbols must have a Play Symbol Caption underneath, unless specified, and each Play Symbol must agree with its Play Symbol Caption;
3. Each of the Play Symbols must be present in its entirety and be fully legible;
4. Each of the Play Symbols must be printed in black ink except for dual image games;
5. The Scratch Ticket shall be intact;
6. The Serial Number and Game-Pack-Ticket Number must be present in their entirety and be fully legible;
7. The Serial Number must correspond, using the Texas Lottery's codes, to the Play Symbols on the Scratch Ticket;
8. The Scratch Ticket must not have a hole punched through it, be mutilated, altered, unreadable, reconstituted or tampered with in any manner;
9. The Scratch Ticket must not be counterfeit in whole or in part;
10. The Scratch Ticket must have been issued by the Texas Lottery in an authorized manner;
11. The Scratch Ticket must not have been stolen, nor appear on any list of omitted Scratch Tickets or non-activated Scratch Tickets on file at the Texas Lottery;
12. The Play Symbols, Serial Number and Game-Pack-Ticket Number must be right side up and not reversed in any manner;
13. The Scratch Ticket must be complete and not miscut, and have exactly seventy-four (74) Play Symbols under the Latex Overprint on the front portion of the Scratch Ticket, exactly one Serial Number and exactly one Game-Pack-Ticket Number on the Scratch Ticket;
14. The Serial Number of an apparent winning Scratch Ticket shall correspond with the Texas Lottery's Serial Numbers for winning Scratch Tickets, and a Scratch Ticket with that Serial Number shall not have been paid previously;
15. The Scratch Ticket must not be blank or partially blank, misregistered, defective or printed or produced in error;
16. Each of the seventy-four (74) Play Symbols must be exactly one of those described in Section 1.2.C of these Game Procedures;
17. Each of the seventy-four (74) Play Symbols on the Scratch Ticket must be printed in the Symbol font and must correspond precisely to the artwork on file at the Texas Lottery; the Scratch Ticket Serial Numbers must be printed in the Serial font and must correspond precisely to the artwork on file at the Texas Lottery; and the Game-Pack-Ticket Number must be printed in the Game-Pack-Ticket Number font and must correspond precisely to the artwork on file at the Texas Lottery;
18. The Display Printing on the Scratch Ticket must be regular in every respect and correspond precisely to the artwork on file at the Texas Lottery; and
19. The Scratch Ticket must have been received by the Texas Lottery by applicable deadlines.
B. The Scratch Ticket must pass all additional validation tests provided for in these Game Procedures, the Texas Lottery's Rules governing the award of prizes of the amount to be validated, and any confidential validation and security tests of the Texas Lottery.
C. Any Scratch Ticket not passing all of the validation requirements is void and ineligible for any prize and shall not be paid. However, the Executive Director of the Texas Lottery ("Executive Director") may, solely at the Executive Director's discretion, refund the retail sales price of the Scratch Ticket. A. Until such time as a signature is placed upon the back portion of a Scratch Ticket in the space designated, a Scratch Ticket shall be owned by the physical possessor of said Scratch Ticket. When a signature is placed on the back of the Scratch Ticket in the space designated, the player whose signature appears in that area shall be the owner of the Scratch Ticket and shall be entitled to any prize attributable thereto. Notwithstanding any name or names submitted on a claim form, the Executive Director shall make payment to the player whose signature appears on the back of the Scratch Ticket in the space designated. If more than one name appears on the back of the Scratch Ticket, the Executive Director will require that one of those players whose name appears thereon be designated by such players to receive payment.
B. The Texas Lottery shall not be responsible for lost or stolen Scratch Tickets and shall not be required to pay on a lost or stolen Scratch Ticket.
4.0 Number and Value of Scratch Prizes. There will be approximately 6,000,000 Scratch Tickets in Scratch Ticket Game No. 2709. The approximate number and value of prizes in the game are as follows:

A. The actual number of Scratch Tickets in the game may be increased or decreased at the sole discretion of the Texas Lottery.
5.0 End of the Scratch Ticket Game. The Executive Director may, at any time, announce a closing date (end date) for the Scratch Ticket Game No. 2709 without advance notice, at which point no further Scratch Tickets in that game may be sold. The determination of the closing date and reasons for closing will be made in accordance with the Scratch Ticket closing procedures and the Scratch Ticket Game Rules. See 16 TAC §140.302(j).
6.0 Governing Law. In purchasing a Scratch Ticket, the player agrees to comply with, and abide by, these Game Procedures for Scratch Ticket Game No. 2709, the State Lottery Act (Texas Government Code, Chapter 466), applicable rules adopted by the Texas Lottery pursuant to the State Lottery Act and referenced in 16 TAC, Chapter 140, and all final decisions of the Executive Director.

Notice is given to the public of an application filed with the Public Utility Commission of Texas (commission) on September 30, 2025, for true-up of 2022 Federal Universal Service Fund (FUSF) Impacts to the Texas Universal Service Fund (TUSF).
Docket Style and Number: Application of Border to Border Communications, Inc. for True-Up of 2022 Federal Universal Service Fund Impacts to the Texas Universal Service Fund, Docket Number 58771.
The Application: Border to Border Communications filed a true-up in accordance with ordering paragraphs 2, 4, and 5 of the Notice of Approval issued in Docket No. 53972, Application of Border to Border Communications, Inc. To Recover Funds from the TUSF Under PURA § 56.025 and 16 TAC § 26.406 for Calendar Year 2022. In that docket, the Commission determined that the Federal Communications Commission's actions were reasonably projected to reduce the amount that Border to Border received in Federal Universal Service Fund (FUSF) revenue by $1,567,055 for calendar year 2022. It was also estimated that Border to Border would recover $1,567,055 of the projected FUSF revenue impact from rate increases implemented for the same time period. Border to Border's request to recover $1,567,055 from the Texas Universal Service Fund (TUSF) for 2022 was approved. Ordering paragraphs 2, 4 and 5 of the Notice of Approval in Docket No. 53972 require Border to Border to file its final and actual FUSF impacts for 2022 by September 1, 2025, with detailed supporting documentation containing the requirements for potential over- or under-recovery from the TUSF. Border to Border states that it did not fully recover the impacted FUSF revenues for 2022. Therefore, Border to Border seeks additional TUSF funds in the amount of $35,191 in this true-up proceeding.

Upper Trinity Groundwater Conservation District
Request for Qualifications for Hydrogeology Services
The Upper Trinity Groundwater Conservation District ("District"), a groundwater conservation district comprised of Montague, Wise, Parker, and Hood counties, is seeking hydrogeologists with the qualifications and experience to assist the District.
The objective of this Request for Qualifications (RFQ) is to solicit information from qualified professionals (Respondents) regarding their skills, abilities, experience, and credentials relevant to providing professional services related to groundwater management, hydrogeology, and software development. The District will consider the information provided to identify a preferred party to attempt to negotiate contract terms for providing the services required by the District.
Qualified professionals must have documented experience working with groundwater conservation districts in Texas, expertise in groundwater availability modeling- including developing groundwater availability models and software related to those models, working with Districts in the development and analysis of desired future conditions and their achievement, analysis of monitoring well data, water well spacing and well interference issues, and related hydrogeological issues. Experience working with the Northern Trinity and Woodbine Aquifers Groundwater Availability Modeling is particularly valued. Consideration will be given to those respondents with experience developing, or managing the development, of software or software interfaces related to groundwater modeling tools such as MODFLOW and TTIM.
If selected, Respondent will serve as a technical consultant and be responsible for assisting the District's General Manager, staff, and Board of Directors (Board) with ongoing and potential studies and programs focused on the collection and analysis of scientific data regarding the groundwater resources in the District and the region. The Respondent may be tasked with providing scientific and technical reports and advice as requested by the General Manager and/or the Board. The Respondent should be available for consultation as needed. Presently, regular board meetings usually occur at 5:00 PM on the third Thursday of each month, although those meeting dates vary from time to time because of holidays and other considerations. The District is actively collecting groundwater data, investigating groundwater resources, and issuing permits. The District participates in joint planning and is a part of Groundwater Management Area 8 and Groundwater Management Area 6.
Interested and qualified professionals should submit a statement of qualifications as described below to the District. Submissions must include one (1) original and ten (10) copies submitted via mail or hand delivery, as well as one electronic copy, to be RECEIVED BY the District no later than 5:00 p.m. on November 10, 2025, at the addresses below, in order to be considered.

Responses to the RFQ should include, without limitation: a title page; table of contents; a general statement of qualifications; key personnel proposed to be assigned to providing the services described herein; a statement of the qualifications of the team, including work experience and resumes; a history of the firm and principles, including years in business (if less than five years, previous experience of principals); evidence of financial capability and financial stability to correctly, timely, and reliably perform the requested services for the District; registrations, licenses, and certifications and other qualifications for key individuals assigned to the District; description of previous work similar to the services requested; if applicable, a listing of clients with water wells producing groundwater in the District; a description of experience involving the major and minor aquifers in the District; description of your professional liability insurance; and a statement certifying that the Respondent and/or his/her firm is not aware of any existing conflicts of interest with the District or its Board of Directors, including the filing of any statements required under Chapter 176, Local Government Code.
Please note that in accordance with Sections 36.057(c) of the Texas Water Code and 2254.004 of the Texas Government Code, submittals must NOT include any cost quotations at this stage in the selection process. Any submittals that include cost quotations will be rejected upon receipt.
Upon receipt by the District, each statement will be stamped with the date and time received and stored unopened in a secure place until 5:00 p.m. on November 10, 2025, after which the statements will be opened by the District's General Manager. All statements become the property of the District, which will hold the contents of all statements confidential until an award is made. Statements received after the deadline set forth above will be declared late and not eligible for opening and consideration. The District is not responsible for mail, courier, or other delivery methods, in-transit time or non-delivery. Late deliveries will be held unopened. Potential firms will be advised by mail or email that their statement was late and not accepted and will be allowed to pick up their statement package.
Selection of a firm shall be in accordance with Section 36.057(c) of the Texas Water Code, and the Professional Services Procurement Act, Subchapter A, Chapter 2254, Texas Government Code. The District may require additional information after the review of the initial information received. Interviews may be conducted individually with one or more of the firms who submit responsive statements and who are determined reasonably qualified for award of the contract.
The District will determine, in its sole discretion, the Respondent or Respondents best qualified overall to perform the required services, based on, but not limited to a consideration of the following: the responsiveness to requirements of this RFQ; relevant experience, expertise, and qualifications as it relates to the aquifers of the District; hydrogeologic modeling and mapping, hydrogeologic investigations, research, and general knowledge of the aquifers in the District; relevant experience, expertise, and qualifications in developing and implementing Groundwater Conservation District (GCD) management plans and rules; experience relevant to the technical aspects of GCD rules relating to well spacing and production limits; relevant experience, expertise, and qualifications supporting GCD Board decisions based on technical hydrogeologic data; experience testifying on behalf of a GCD in a contested case; relevant experience, expertise, and qualifications working for other GCDs; relevant experience, expertise, and qualifications working on the joint planning process within Groundwater Management Areas (GMAs) and developing Desired Future Conditions (DFCs); and accessibility, responsiveness and access to client.
By submitting a Response to this RFQ, the Respondent: (a) acknowledges and accepts the evaluation process; and (b) understands that the determination of the most qualified Respondent will require the exercise of subjective judgment by the Board.
After the Respondent is selected by the District, the Parties will endeavor to enter into a contract for services in the manner provided by law, including Chapter 2254 of the Texas Government Code. That contract shall: (a) define and describe the scope of services, the agreed-upon and reasonable fees for such services, and reimbursable expenses prior to any services being performed under the contract; (b) be drafted in a form and scope which is acceptable to the District and the Respondent; and (c) recite a fair and reasonable price for the services to be provided, however, the professional fees under the contract may not exceed any maximum provided by law. Final selection of a firm will be made by the District's Board of Directors. THE SUBMISSION OF A RESPONSE CONSTITUTES THE ACCEPTANCE BY THE RESPONDENT OF THE EVALUATION TECHNIQUE DESCRIBED IN THIS RFQ.
If acceptable statements of qualifications are not submitted, as determined in the sole discretion of the Board, the District retains the right to not award a contract in response to this RFQ.
